الشروط والأحكام — Terms & Conditions
تحكم هذه الشروط والأحكام استخدامك لموقع وخدمات الشريف لخدمات التسويق والتطوير التقني (المشار إليها بـ "الشركة")، وتخضع للتشريعات النافذة في دولة ليبيا. باستخدامك موقعنا أو طلبك أي خدمة من خدماتنا فإنك توافق على هذه الشروط.
1. نطاق الخدمات
تقدم الشركة خدمات التطوير التقني والتسويق والخدمات المالية والرقمية والسفر والتأمين وغيرها كما هو موضح في الموقع. بعض الخدمات يتم تنفيذها بالنيابة عنك لدى طرف ثالث (مثل Sony وSteam وBinance وشركات الطيران وشركات التأمين)، وفي هذه الحالة نعمل كوسيط، وتبقى شروط ذلك الطرف الثالث نافذة على الخدمة.
2. الطلبات والأسعار والدفع
الأسعار المعروضة بالدينار الليبي وتأكد كتابياً (عبر واتساب أو البريد) قبل التنفيذ. للخدمات الرقمية والبطاقات يكون الدفع مقدماً، وللمشاريع البرمجية حسب الاتفاق المكتوب. قد تتغير أسعار العملات الرقمية والخدمات الدولية حسب السوق وقت التنفيذ.
3. الخدمات الرقمية والبطاقات
البطاقات والأكواد وأرصدة الشحن والاشتراكات تُعد مسلّمة فور إرسالها إليك، ولا يمكن إرجاعها أو استبدالها بعد التسليم لطبيعتها الرقمية، إلا إذا ثبت أن الكود معيباً قبل استخدامه — وعندها نعوضك أو نستبدله بعد التحقق.
4. التأمين والسفر والتأشيرات
خدمات التأمين والطيران والتأشيرات تخضع لشروط الجهات المصدرة (شركات التأمين والطيران والسفارات). لا تتحمل الشركة مسؤولية رفض التأشيرة أو تعديل الأسعار أو إلغاء الرحلات من الناقل، ويلتزم العميل بصحة البيانات والمستندات المقدمة.
5. تحديد المسؤولية
إلى أقصى حد يسمح به القانون الليبي، لا تتحمل الشركة أي أضرار غير مباشرة أو تبعية أو فوات فرصة أو خسارة أرباح ناتجة عن استخدام خدماتنا أو تعذرها. وبجميع الأحوال لا تتجاوز مسؤوليتنا الإجمالية قيمة المبلغ الذي دفعته مقابل الخدمة محل النزاع. كما لا نضمن توافر خدمات الأطراف الثالثة أو استمراريتها أو خلوها من الأخطاء.
6. القوة القاهرة
لا تعد الشركة مسؤولة عن أي تأخير أو تعثر ناتج عن ظروف خارجة عن إرادتها مثل انقطاع الكهرباء أو الاتصالات أو الأعطال لدى مزودي الخدمة أو الأوضاع العامة الاستثنائية.
7. الملكية الفكرية
المواقع والأنظمة المطورة خصيصاً تنتقل ملكيتها للعميل بعد سداد كامل المستحقات. تحتفظ الشركة بحق عرض العمل ضمن معرض أعمالها ما لم يتفق كتابياً على غير ذلك.
8. القانون الواجب التطبيق وحل النزاعات
تخضع هذه الشروط للقانون الليبي النافذ، وتختص محاكم مدينة طرابلس بأي نزاع ينشأ عنها، مع أولوية الحل الودي أولاً.

These terms govern your use of the website and services of Al-Sharif Marketing & Tech Development Services (the "Company"), and are subject to the laws in force in the State of Libya. By using our website or ordering any service, you agree to these terms.
1. Scope of Services
The Company provides tech development, marketing, financial, digital, travel, insurance and other services as described on this website. Some services are executed on your behalf with third parties (such as Sony, Steam, Binance, airlines and insurance companies); in such cases we act as an intermediary and the third party's own terms apply to the service.
2. Orders, Pricing & Payment
Prices are displayed in Libyan Dinars and confirmed in writing (via WhatsApp or email) before execution. Digital services and cards require payment in advance; software projects follow the written agreement. Prices of digital currencies and international services may change with the market at execution time.
3. Digital Services & Cards
Cards, codes, top-up credits and subscriptions are considered delivered once sent to you, and cannot be returned or exchanged after delivery due to their digital nature — unless the code is proven defective before use, in which case we compensate or replace it after verification.
4. Insurance, Travel & Visas
Insurance, flight and visa services are subject to the issuing bodies' terms (insurance companies, airlines, embassies). The Company is not responsible for visa refusals, price changes or carrier cancellations, and the client is responsible for the accuracy of submitted data and documents.
5. Limitation of Liability
To the maximum extent permitted by Libyan law, the Company bears no liability for any indirect or consequential damages, lost opportunities or lost profits arising from the use of, or inability to use, our services. In all cases, our total liability shall not exceed the amount you paid for the disputed service. We do not guarantee the availability, continuity or error-free operation of third-party services.
6. Force Majeure
The Company is not liable for any delay or failure caused by circumstances beyond its control, such as power or telecom outages, provider failures, or exceptional public conditions.
7. Intellectual Property
Custom-developed websites and systems transfer to the client upon full payment. The Company retains the right to display the work in its portfolio unless otherwise agreed in writing.
8. Governing Law & Disputes
These terms are governed by the laws in force in Libya, and the courts of Tripoli have jurisdiction over any dispute, with amicable resolution preferred first.
